GENERAL
At SOBA, we are dedicated to delivering classes and services on time as advertised, but please be aware that schedules may be subject to change due to unexpected circumstances, leading to class cancellations or modifications.
SOBA holds no liability for refunding, transferring, or compensating for classes missed or canceled within three hours of the booked class. We are not responsible for the safekeeping of your belongings, and the right to refuse entry is reserved.
All purchases made with SOBA are final, and we do not offer refunds for services or products due to changes of mind. Gift cards may be redeemed for classes, memberships, or products but are not redeemable for cash. Prices may occasionally change to reflect increases in costs, benefits, or services.
It is the client's responsibility to notify the instructor of any injuries, health concerns, or pregnancy in each class to facilitate necessary adjustments and modifications. Abdominal exercises, bends, and HIIT classes are not recommended in the first trimester of pregnancy. For personalised pregnancy information, please email us at contact@soba.com.au
Clients must read and sign a waiver, process the intro offer, and/or paid for a pass to attend a class due to health, safety, and legal issues. If you have not paid for the service SOBA has the right to charge you for the services you have completed at the most cost effective rate.
Instructors are not available to discuss client accounts. Instructors are employed to teach incredible classes only. SOBA offers are virtual reception Monday, Wednesday and Thursday - Please email contact@soba.com.au - our response can take 3-5 business days to respond.
PASSES, MEMBERSHIPS & AUTOPAY'S.
Our introductory offer is exclusively for new local clients only. If a client has created another account and processed an additional intro offer a charge will in-cure for the classes taken.
Memberships, auto-pays, and passes are non-transferable, interchangeable, or shareable between clients. Sharing memberships results in permanent forfeiture. All upfront memberships, passes, gift cards must be activated within 12 months from the purchase date. If you need an extension of activation time, please notify SOBA at the time of purchase. Auto-pay and upfront suspensions are available, limited to four weeks within one year, each for a minimum of one week.
Auto-pay can be cancelled after three months please email contact@soba.com.au or swipe auto conversion off on the desktop function. 12 month contract Auto-pay can be cancelled however it may enquire a cancellation fee.
To suspend or cancel a membership or contracted autopay , email contact@soba.com.au prior to the next billing date.
For medical reasons or pregnancy, longer holds are possible with a doctor's certificate, and memberships must be for a minimum of one week.
Post Pass Auto-pay converts when passes end, and you, as the client, have full control over cancellations, providing flexibility with your schedule. (No contract) Post Pass Auto Pay is $126.50 per month offering you access to unlimited classes for the month. You may terminate your membership at any time via email or desktop login. Cancellation made before the end of the billing cycle results in cancellation as of the following month, with no refund for the current period.
CLASS CANCELLATIONS
Class cancellations must be made via the SOBA booking system or our mobile app up to three hours prior to the class start time. If canceled within the three-hour window, a ten-dollar penalty will be processed within 24 hours.
A missed booked class is classified as a no-show, resulting in forfeiting the class on your pass and/or a ten-dollar fee. Email us at contact@soba.com.au for unforeseen circumstances to avoid unnecessary charges. Cancellation fees are automated.
LIABILITY WAIVER
Our liability waiver is accessible through your SOBA profile and is agreed upon with every purchase. It remains valid for the full attendance of your purchase and continues to roll over on each subsequent purchase. View the waiver on your SOBA profile at any time. If updated at anytime you will be prompted to read and sign the new terms before continued attendance.
HEALTH
Physical exercise, in all of its forms and with or without the use of equipment such as blocks, straps or any other equipment that may be suggested by a SOBA instructor, is a strenuous physical activity. Accordingly, you are urged and advised to seek the advice of a physician before beginning any physical exercise regimen, routine, program or using any suggested equipment, shown in any of our in-studio and online classes. SOBA is not a medical organisation and its instructors or staff cannot give you medical advice or diagnosis. All suggestions and comments relating to the use of equipment, poses, moves and instruction are not required to be performed by you and are carried out at your election while attending or viewing a class.
By attending and viewing SOBA classes you represent that you understand that physical exercise involves strenuous physical movement, and that such activity carries the risk of injury whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities for such activities. It is your responsibility to ensure that by participating in classes and activities in-studio on online, you will not exceed your limits while performing such activity, and you will select the appropriate level of classes for your skills and abilities, as well as for any mental or physical conditions and/or limitations you have. You understand that, from time to time instructors may suggest physical adjustments or the use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition. You expressly waive and release any claim that you may have at any time for injury of any kind against SOBA, or any person or entity involved with SOBA, including without limitation its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates and representatives.
THIRD PARTY
SOBA is not responsible for refunding services due to third-party interventions, such as government restrictions or a pandemic. Memberships may be placed on hold, transferred to online membership, or converted to a gift voucher dollar value.
PRIVACY
SOBA is committed to protecting all information collected from you. Information is used to create a personal profile within our community. We are a cashless studio, accepting only Visa debit or credit cards, with cash donations accepted only in our community class.
Wellness living has a privacy policy, separate from SOBA, and any information provided on their website is subject to their privacy policy. Changes to our privacy policy will be displayed on our website.

WORKSHOPS
There are no refunds, transfers, or exchanges for bookings to special events or workshops. Occasionally, SOBA workshops may have the option of BYO alcohol, if consuming alcohol responsible drinking is required.
VACAY
Deposits confirm your reservation and are non-refundable but transferable. Full payment must be made before ninety days of the vacation. Refunds may be granted before 90 days notice, excluding the deposit.
SOBA is not responsible for expenses incurred due to canceled/refunded vacations. Participants acknowledge voluntary participation in all vacation activities and surrender any right to legal action against SOBA for loss or damage during the vacation.

STUDIO HIRE
SOBA offers studio hire to external parties. Credit card details are taken for security. SOBA is not responsible for third-party damages. A set rate is agreed upon and must be paid upfront a minimum 24 hours before the event. The studio must be vacuumed after event.
ONLINE SUBSCRIPTIONS
You may terminate your membership at any time through the instructions at contact@soba.com.au. Cancellation before the end of the billing cycle results in account cancellation as of the following month/year, with no refund for the current period.
SOBA reserves the right to terminate your account or access to the online studio immediately if there is a belief in the breach of terms, furnishing false information, or interfering with others' use of the online studio.
When closing or deactivating your account, we have the right to store your personal information, settings, saved and completed classes, and followed teachers, with reactivation possible at any time via email.
No sharing of passwords or usernames is allowed. Fraudulent use of the online studio results in immediate cancellation without refund. SOBA may cancel compromised or fraudulently used memberships at its discretion.
Billing occurs monthly and yearly, with memberships renewed automatically until canceled. Terminated memberships will not be reimbursed for the remaining paid period. Cancellations must be made before the renewal date to end membership charges.
Physical exercise involves risks, and you must judge your capabilities for such activities. By using the online studio, you waive any claim for injury against SOBA, its directors, instructors, and representatives.
You are solely responsible for your interactions with SOBA online subscription and in-studio experience.
