GENERAL
At SOBA, we are committed to delivering our classes and services on time as advertised. However, schedules may be subject to change due to unforeseen circumstances, which may lead to class cancellations or modifications. SOBA reserves the right to substitute instructors, change class formats, or adjust schedules where required.
SOBA holds no liability for refunding, transferring, or compensating for classes missed or canceled within three hours of the scheduled class. We are not responsible for the safekeeping of your belongings, and we reserve the right to refuse entry at our discretion.
All purchases made at SOBA are final. We do not offer refunds for services or products due to a change of mind. Gift cards can be redeemed for classes, memberships, or products, but cannot be exchanged for cash. Prices may occasionally change to reflect increases in costs, benefits, or services.
It is the responsibility of clients to notify the instructor of any injuries, health concerns, or pregnancy before each class to ensure necessary adjustments and modifications can be made. Some movements such as abdominal exercises or bends are not recommended during the first trimester of pregnancy. For personalised pregnancy information, please email us at contact@soba.com.au.
Clients must sign our terms / waiver and have processed the intro offer or paid for a pass to attend classes due to health, safety, and legal reasons. If services have not been paid for, SOBA reserves the right to charge completed services at the applicable casual class rate or equivalent pass rate.
Instructors are not available to discuss client accounts. They are employed to teach exceptional classes only. SOBA operates primarily via virtual reception, for all account queries, please email us at contact@soba.com.au, response times are typically 3–5 business days.
PASSES & MEMBERSHIPS
Our introductory offer is available exclusively for new local clients. If a client creates multiple accounts to take advantage of additional intro offers, SOBA reserves the right to charge for the classes taken.
Memberships and passes are non-transferable, non-interchangeable, and non-shareable between clients. Sharing memberships will result in permanent forfeiture.
All upfront memberships, passes, and gift cards must be activated within 12 months of the purchase date. If an extension is needed, please notify SOBA at the time of purchase.
Membership pauses are available and are limited to four weeks per calendar year, with each pause lasting at least one week.
For medical reasons or pregnancy, longer membership pause periods may be granted with a doctor’s certificate.

WEEKLY UNLIMITED MEMBERSHIP (AUTOPAY)
Minimum commitment period
Unlimited Weekly memberships have a minimum commitment of 12 weeks from the start date. During this initial period, the membership cannot be cancelled.
After the minimum commitment
Once the initial 12-week commitment has been completed, the membership will continue on an ongoing week-to-week basis.
Cancellation
Cancellations may be requested at any time after the initial 12-week commitment, subject to 14 days’ notice.
The membership will remain active, and weekly payments will continue, during the 14-day notice period. No further charges will apply after the notice period has ended.

The 14-day notice period begins from the date written notice is received.
Unused memberships, missed classes, or changes in attendance do not constitute notice of cancellation.
Failed payments
If a scheduled payment fails, SOBA reserves the right to:

CLASS CANCELLATIONS
Class cancellations must be made via the SOBA booking system or mobile app up to three hours before the class start time. Cancellations made within the three-hour window will incur a $10 penalty, processed within 24 hours.
A missed class is classified as a no-show, resulting in forfeiture of the class on your pass and/or a $10 fee. For unforeseen circumstances, please email us at contact@soba.com.au to avoid unnecessary charges. Cancellation fees are automated.
LIABILITY WAIVER
By participating in any in-studio or online class, workshop, or event offered by SOBA, you acknowledge that physical exercise, whether with or without equipment, involves inherent risks, including injury or harm. You voluntarily assume full responsibility for any risks, injuries, or damages, known or unknown, that you may incur as a result of your participation, whether in-person or remotely.
You agree to release, indemnify, and hold harmless SOBA, its instructors, staff, and affiliates from any claims, liabilities, or expenses arising from your participation in any of our services, including but not limited to in-studio classes, online classes, and workshops.
It is your responsibility to notify SOBA instructors of any health conditions, injuries, or pregnancies prior to class so that appropriate modifications can be provided. All physical adjustments and exercise suggestions are optional, and you must assess your ability to participate safely.
By attending any SOBA class or accessing our online platform, you confirm that you are participating at your own risk, and it is your responsibility to seek medical advice from a physician if necessary before engaging in any physical activity.
HEALTH
Physical exercise, whether in-studio or online, involves strenuous activity. We urge you to consult with a physician before beginning any new exercise regimen, especially if using equipment such as blocks or straps suggested by our instructors. SOBA is not a medical organization, and our instructors cannot provide medical advice or diagnoses. Any suggestions made by instructors are optional, and you choose whether or not to follow them.
By attending SOBA classes, you acknowledge the risks of physical exercise and understand it is your responsibility to gauge your physical and mental capabilities. You are responsible for selecting the appropriate level of activity based on your abilities and any existing conditions. From time to time, instructors may suggest adjustments, and it is your responsibility to determine if these are appropriate for you. You expressly waive and release any claim of injury against SOBA or any affiliated party.
THIRD PARTY
SOBA is not responsible for refunding services due to third-party interventions such as government restrictions or pandemics. Memberships may be placed on hold, transferred to an online membership, or converted to a gift voucher.
PRIVACY
SOBA is committed to protecting your information. This data is used to create a personal profile within our community. SOBA is a cashless studio, accepting only Visa debit or credit cards, with cash donations accepted for community classes.
SOBA uses Mindbody for booking and account management. Please refer to their privacy policy, which is separate from ours. Any changes to SOBA’s privacy policy will be displayed on our website.

PHOTOGRAPHY & VIDEO
SOBA may capture photo and video content in classes, events, and studio spaces for marketing and community purposes.
Where possible, reasonable notice will be provided. Clients who do not wish to appear in identifiable content should notify us at contact@soba.com.au.
WORKSHOPS
No refunds, transfers, or exchanges are available for bookings to special events or workshops. Occasionally, SOBA workshops may allow BYO alcohol, and responsible consumption is required.
VACATIONS
Deposits for vacation bookings confirm your reservation and are non-refundable but transferable. Full payment must be made 90 days before the vacation. Refunds may be granted with 90 days' notice, excluding the deposit.
SOBA is not responsible for expenses incurred due to canceled vacations. Participants voluntarily join all activities and waive the right to legal action against SOBA for loss or damage during the vacation.
STUDIO HIRE
SOBA offers studio hire to external parties. Credit card details are collected for security purposes. SOBA is not responsible for third-party damages. A set hire rate must be paid upfront, at least 24 hours before the event. The studio must be cleaned after use.
ONLINE SUBSCRIPTIONS
You may terminate your online subscription at any time. Cancellations made before the end of the billing cycle will take effect the following month or year, with no refunds for the current period.
SOBA reserves the right to terminate accounts if there is a breach of terms or fraudulent activity. When deactivating your account, we may retain your personal information and reactivation settings. No sharing of usernames or passwords is allowed.
Subscriptions are billed monthly or yearly and renew automatically unless canceled. Terminations will not be reimbursed for the remaining paid period. Cancellations must be made before the renewal date.
Physical exercise involves risks. By using the online studio, you waive any claims for injury against SOBA and its representatives.
BEHAVIOUR + COMMUNITY STANDARDS
SOBA reserves the right to suspend or terminate access for behaviour that is unsafe, abusive, disruptive, or inconsistent with community values.
